These terms and conditions apply to the use of the website www.fisonzair.co.uk and telephone orders placed with Fison Zair Studio. By using the website, placing an order with us or using our services, you will be deemed to have read, understood and agreed to these terms and conditions.

Terms of Service.

This website is operated by Katy Aston for Fison Zair Studio. Throughout the site, the terms I, We, Us and Our may be used and refers to Fison Zair Studio. The contents of this website are for personal, non commercial use and are published solely for promoting our products and services.

Condition of Use

We reserve the right to refuse service to anyone for any reason at any time.

Ordering

Orders can be processed directly through this website. Fison Zair Studio processes card payments securely via Paypal/Credit Card payment facility. All transactions are processed using a secure server. Fison Zair Studio does not hold any customer card details and will never pass your details onto anyone.

Payment.

All orders are required to be paid for upon submission of the order via Fison Zair website or over the phone using the PAYPAL/Credit Card payment facility. Orders will not be processed or dispatched until funds have cleared.

Personal Information.

Your privacy and security are very important to us. Fison Zair Studio will not share your email, address or any other details with any other party. Please read below for more information.

Data Protection.

We have no direct contact with any of your financial details such as bank account or credit card information during any part of the payment process. Only your basic personal details are available to us, specifically relating to your order (name, email and the billing/delivery addresses which you provide during checkout).

Your personal details are never stored on a local computer. Your basic personal details are printed solely for the purposes of providing a delivery note, and any surplus copies are destroyed before disposal.

Fison Zair Studio will only contact you if necessary on matters arising directly from you order and not for any other purposes (unless you have signed up for our mailing list, see below).

Mailing List.

Our mailing list is available on an opt-in basis only. If you have chosen to subscribe our mailing list the email address you provide will not be passed on to any other companies and will only be used by us as stated, that is, infrequent emails about new products, news etc. You can opt out by unsubscribing at any time.

Use of Cookies.

Our website uses cookies; by using our website or agreeing to these terms of service, you consent to our use of cookies in accordance with the terms of our Privacy and Cookies Policy.

Accuracy of Content.

Every care has been taken to ensure that descriptions, measurements, colours and prices are correct. We reserve the right to amend prices at any time. Please note that there may be some variation in the colour of goods shown on the website due to the limitations of photographic and web processes and we cannot be held responsible for any variations in colour that may arise caused by your browser or computer software.

Errors, Inaccuracies and Omissions.

We reserve the right to correct any errors, inaccuracies or omissions, and to change or update information or cancel orders if any information in the Service or on any related website is inaccurate at any time without prior notice. We will always contact you via email should such inaccuracies affect your order.

Indemnity.

By using our website, products and services hereby indemnify us and undertake to keep us indemnified against all and any liabilities, losses, damages, expenses and costs (including legal expenses and amounts paid in settlement of any demand, action or claim) arising, directly or indirectly, out of a breach by you of any of your obligations under these terms of sale.

Limitations of Liability

Nothing in these terms of sale will limit or exclude your or our liability for: (i) death or personal injury caused by negligence; (ii) fraud or fraudulent misrepresentation; or (iii) any matter for which it would be illegal to limit or exclude, or attempt to limit or exclude, liability.

Subject to this:

(a) our liability in connection with any product purchased through our website is strictly limited to the purchase price of the relevant product and the replacement cost of the relevant product;

(b) we will not under any circumstances be liable for any loss of income or revenue, loss of business, loss of profits or contracts, loss of anticipated savings, loss of data or waste of management or office time, or loss of goodwill or reputational damage; and

Prices and Availability.

Prices of our products are subject to change without notice. All items are offered subject to availability at time of ordering. However, should an item be out of stock there may be short delays in delivery and we will notify you immediately. Fison Zair Studio will have no liability to you for any failure to deliver goods you have ordered or any delay in doing so for any damage or defect to goods delivered that is caused by any event or circumstance beyond our reasonable control.

Cancellation.

If you wish to cancel an order please contact the studio at hello@fisonzair.co.uk. By placing a bespoke order with us you are committing to our 'Made to Order' process meaning there is limited opportunity to cancel or change an order due to the bespoke nature of our service.

Delivery.

Fison Zair uses a variety of delivery companies to deliver your goods. these companies deliver within standard working hours of 9am-5pm, Monday to Friday. It is customers responsibility to ensure the goods can be received within these timescales. We aim to dispatch orders within 3-5 days, subject to stock availability. Bespoke orders or made to order products will take longer, you will be contacted at time of ordering with an estimated dispatch date.

VAT & Import Duty.

No VAT is added as Fison Zair is currently not a VAT registered company. Import duties or taxes may be incurred by the customer if ordering for delivery to a country outside of the UK. Fison Zair Studio is not responsible for any import duties or tax which may be applicable in your country.

Returns.

We accept returns in their original packaging, unused, within 14 days. Items are to be returned at the customers expense via a trackable method. Cut fabric is non-returnable. Please check all fabric before cutting. We would recommend you order fabric swatches before ordering to make sure you are happy. Bespoke orders are non refundable unless damaged or faulty upon receipt of goods. Many of our fabrics are printed on a 'Made to Order' basis

Faulty Goods.

Fison Zair Studio does not accept returns for naturally occurring deviations such as slubs, we recommend you obtain a fabric sample before placing an order with us.

As many of our products are made by hand there may be a fractional variation in size, this is not deemed to be a fault. Some of our products are made solely by hand, variations in size, shape and markings add character to the product and are not deemed to be a fault.

Fison Zair Studio will not accept any liability for defects or faults occurring as a result of processing or after treatment by an external source, and will not accept any claims for any loss or issue arising thereafter.

Variation.

These Terms and Conditions may be changed by Fison Zair Studio at any time at its sole discretion. Such changes will be posted on this website and as a result you will be notified. Revised Terms and Conditions will take effect 7 days after posting.
